 Namchi Special Court Takes In Bhandari's Corruption Case
The hearing started on 1 February, wherein the first three days shall have an argument of the prosecution with another three days from the defendant. The case was registered under RC-1(A)/97-ACU (V) dated 24.01.97 13(2) r/w 13(1)(e) of Prevention of Corruption Act, 1988 and 193 Indian Penal Code in CBIGANGTOK, February 02: Following directions from the High Court of Sikkim the Special Judge of Namchi District Court started hearing the arguments of the prosecution and defence counsel in the pending case of state Congress President Nar Bahadur Bhandari. The High Court of Sikkim has further directed the Namchi District Court to take in day-to-day hearing of the Central Bureau of Investigation (CBI) case and deliver the judgment within six days. The hearing started on 1 February, wherein the first three days shall have an argument of the prosecution with another three days from the defendant. The case was registered under RC-1(A)/97-ACU (V) dated 24.01.97 13(2) r/w 13(1)(e) of Prevention of Corruption Act, 1988 and 193 Indian Penal Code in CBI. The CBI charge sheeted on the basis that Nar Bahadur Bhandari was in possession of huge assets, which were disproportionate to his known sources of income during his Chief Ministership of Sikkim from 1985-1994. Also on the grounds that during his Chief Ministership from 1985 to 1994, Bhandari acquired assets in his own name and in the name of his own family members worth Rs 1,11,56,000 as against his income of Rs 44 Lakhs during the period. Ganesh Verma, Deputy Superintendent of Police, CBI, Anti Corruption Unit (V) was designated as investigating officer then. During investigation the CBI revealed that total assets of Nar Bahadur Bhandari by the end of check period amounts to Rs 1,09,56,491. Bhandari was also found to have in possession assets to the tune of Rs 53,60,783, which were disproportionate to his known sources of income. Reports reveal that Bhandari came up with defense that he had received Rs 25 Lakhs from former Prime Minister Ms Indira Gandhi and also received heavy funds from late Rajiv Gandhi as well financial receipts as publisher of M/s Archana Publications. CBI report states the allegation of acquisition of assets disproportionate was proved against Congress supreme NB Bhandari. The allegation of fabrication of false evidence by preparing an ante dent agreement on or after August 1995 and ante dating the same as 30 June 1990 was also proved, finally CBI charge sheeted Nar Bahadur Bhandari. Total assets of NB Bhandari at the end of check period: Rs 1,09,56,491 Assets at the beginning of check period: 1. As per inventory items acquired up to 31 December 1988: Rs 87,000 2. Balance in bank accounts: Rs 1,166 Total: 88,966 Calculation of Disproportionate Assets The assets acquired by NB Bhandari during the check point comes (Rs 1,09,56,491 – Rs 88,966) = Rs1, 08, 67525. Likely savings Rs 62,78,165 – Rs 7,71,422 = Rs 55,06,742 Disproportion = Rs 1,08,67,525 – Rs 55,06,742 = Rs 53,60,783
