GANGTOK, November 30: The latest row over Rule 4(4) of Sikkim Government Establishment Rules 1974 following apprehensions about the same to be dissolved under legal grounds, today came with the Chief Minister’s assurance towards making it a ‘State Law’ in a meeting with 11 member executive body of the newly formed 27th November Committee.
Much critical apprehension about the age old law of the state was advocated by the concerned individuals and leaders of late procuring authenticity of the law and its legal applications for the last few days by judicial wing of the state, that apparently seems to declare the same as invalid.
The origin of the law has its roots during the pre-merger period under Chogyal monarchy which, after its merger with India on 8 May 1973, all the old laws of the state after 1975 was safeguarded under Article 371F (k) of the Indian Constitution. The authenticity of Rule 4(4) of the Sikkim Government Establishment Rules 1974 lies in the fact that it is a fully written document, hence, enjoying the status of a state law.
In today’s meeting with the Chief Minister, the 27th November Committee placed a four-point memorandum largely advocating the interest of local masses. The committee demanded that the state government should step ahead and pass a Bill in the state Assembly at the earliest and give it a status of state law. Moreover, if the committee’s demand goes unheeded, the committee declared to carry out a peace rally and state wide strike against the same.
The Chief Minister on his part assured the committee to place the issue during the winter session of the Assembly and make it a state law. He as well bid the committee to solve the problem by itself and rest on the judgment of the civil society as a whole without involving any political parties functioning in the state. “The procedure however should not come under political pressure as it is largely an issue of the public”, added the Chief Minister.
The second meeting of the committee is scheduled be held on 1 December at Sikkim Government Employee’s guest house situated at Lower Sichey.
